Terms of Service

1. Your Acceptance of our Terms of Service

This is an agreement between Deep Impact Innovations Limited, a private company with limited liability incorporated in England (“Deep Impact Innovations”), the owner and operator of the Kyrylity software, the mobile smart device application Kyrylity Contacts, www.kyrylity.com (the “Kyrylity Website”)(collectively, including all content delivered by Deep Impact Innovations through Kyrylity Contacts and the Kyrylity Website, the “Kyrylity Service”), and you (“you” or “You”), a user of the Kyrylity Service.

By using the Kyrylity Service, you acknowledge and agree to Deep Impact Innovations’ Terms of Service and Privacy Policy. If you do not agree with every part of these Terms of Service, you are not authorized to use the Kyrylity Service.

 

2. The Kyrylity Service

These Terms of Service are applicable to all Kyrylity Service users. When using the Kyrylity Service, you acknowledge and agree that Deep Impact Innovations is not responsible for any damages, claims or other liability arising from or related to your use of any third-party website. Third party websites are not owned or controlled by Deep Impact Innovations. Deep Impact Innovations has no jurisdiction over, and assumes no responsibility for, the content, privacy policies, or operational practices of any third party websites.

 

3. Access to the Kyrylity Service

I. Conditional on your compliance with these Terms of Service, Deep Impact Innovations authorizes you to use the Kyrylity Service, provided: (a) you use the Kyrylity Service solely for your personal use; (b) you do not resell or charge others for use of or access to the Kyrylity Service; (c) you do not use the Kyrylity Service in any manner inconsistent with these Terms of Service; (d) you do not plagiarize or distribute any part of the Kyrylity Service via any medium without the prior written authorization of Deep Impact Innovations; (e) you do not endeavour to reverse engineer or modify any section of the Kyrylity Service; and (f) you comply with every term and condition of these Terms of Service and the Privacy Policy.

 

II. In order to access and use the Kyrylity Service, you acknowledge and agree that you must provide Deep Impact Innovations with your legitimate mobile phone number. You acknowledge and agree that in order to provide the Kyrylity Service, Deep Impact Innovations will access your contact list and/or address book on your mobile smart device to track the mobile phone numbers of other Kyrylity Service users. You consent to Deep Impact Innovations accessing your contact list and/or address book on your mobile smart device to provide the Kyrylity Service. You are solely responsible for the User Status Submissions that you submit and that are displayed for your mobile phone number on the Kyrylity Service. You must notify Deep Impact Innovations immediately of any security breach of your Kyrylity Service account. Deep Impact Innovations will not be liable for any of your losses caused by any security breach of your Kyrylity Service account, however you may be liable for Deep Impact Innovations losses resulting from such security breaches.

 

III. You agree not to use any marketing or data-mining software to access the Kyrylity Service. You agree not to use any software that sends mass requests to the Deep Impact Innovations servers. You agree not to collect or extract any Kyrylity Service user personally identifiable information, including phone number, from the Kyrylity Service. You are forbidden from extracting any Kyrylity Service user personally identifiable information from Deep Impact Innovations servers via software that runs automated tasks. Deep Impact Innovations does authorize public search engine operators to use spiders to copy content from the Kyrylity Website for the sole purpose of creating publicly available searchable indices. Deep Impact Innovations specifically forbids any efforts to reverse engineer or modify any section of the Kyrylity Service. Deep Impact Innovations forbids the use of request modification tools that explore or harm, penetrate or test the Kyrylity Service. You must obtain written authorization from Deep Impact Innovations prior to testing, measuring or monitoring any section of the Kyrylity Service or Deep Impact Innovations servers. You agree not to use the communication systems provided by the Kyrylity Service for any commercial solicitation or spam purposes. You agree not to spam, or solicit for commercial purposes, any users of the Kyrylity Service.

 

4. Deep Impact Innovations Intellectual Property Rights

The intellectual property rights to the Kyrylity Service including design, graphics, written content, and interactive features, except User Status Submissions (as defined in Section 5), and the trademarks, service marks and logos contained therein, are owned by or licensed to Deep Impact Innovations, subject to the copyright and other intellectual property laws of England, European Union, United States and other countries. The Kyrylity Service is provided to you AS IS for your information and personal use only. Deep Impact Innovations reserves all rights not expressly granted in and to the Kyrylity Service. You agree to not to use, copy, or distribute of any part of the Kyrylity Service other than expressly permitted herein. You agree to not to use, copy, or distribute the User Status Submissions of third parties obtained through the Kyrylity Service for any commercial purposes.

 

5. User Status Submissions

I. The Kyrylity Service allows Kyrylity Contacts users to submit Business Profile Personally Identifiable Information, Social Profile Personally Identifiable Information, Business Profile photos, Social Profile photos, messaging status information, and other personally identifiable communications, as well as the automatic submission of your “online” and “last seen” status (collectively, the “User Status Submissions”). Your User Status Submissions may be hosted, shared, and/or published as part of the Kyrylity Service. Your User Status Submissions may be viewed globally by other Kyrylity Service users who have your mobile phone number in their mobile smart device and which you have not blocked. You acknowledge and agree that any User Status Submissions may be viewed globally by users that have your mobile phone number. Messages, photos and files that you send directly to other Kyrylity Service user(s) will only be viewable by those Kyrylity Service user(s). Kyrylity Service users can only share Kyrylity Business contact information and Kyrylity Social contact information if both users save each other’s mobile phone number to the contact list and/or address book on their mobile smart device. Kyrylity Service users are advised against the submission of sensitive personally identifiable information to the Kyrylity Service. You always retain your ownership rights to your User Status Submissions. You acknowledge and agree that in any event Deep Impact Innovations cannot guarantee any confidentiality with respect to any of your User Status Submissions.

 

II. You are solely responsible for your own User Status Submissions and the consequences of submitting them or publishing them. The Kyrylity Service remains a solely conduit for human social and professional interaction. User Status Submissions of Kyrylity Service users do not represent the views or opinions of Deep Impact Innovations. Deep Impact Innovations cannot and will not guarantee the validity or legality of any User Status Submissions. Regarding your User Status Submissions, you warrant that: (a) you own or have the necessary licenses, rights, and authorizations to use all patent, trademark, copyright or other proprietary rights relating to all your User Status Submissions to enable inclusion in the Kyrylity Service in accordance with these Terms of Service; (b) you can and do authorize Deep Impact Innovations to use all patent, trademark, copyright or other proprietary rights relating to all your User Status Submissions in the Kyrylity Service; (c) you have written authorization from each and every individual person identified in your User Status Submissions to use their name or likeness in the manner envisaged by the Kyrylity Service and these Terms of Service. Upon submission of your User Status Submissions to the Kyrylity Service, you grant Deep Impact Innovations a free, globally applicable, non-exclusive, transferable licence to use, modify, reproduce, distribute and publicize your User Status Submissions, including without limitation for the promotion and redistribution of part or all of the Kyrylity Service in any media format and through any media channels. You also grant every Kyrylity Service user a non-exclusive license to access your User Status Submissions in the manner envisaged by the Kyrylity Service and these Terms of Service. The license granted by you to other Kyrylity Service users terminates once you remove or delete your User Status Submissions from the Kyrylity Service.

 

III. Regarding your User Status Submissions, you further warrant that: (a) you will not submit material that is copyrighted or subject to third party proprietary rights, unless you are the owner of such rights or have written authorization from their rightful owner to include the material in your User Status Submissions and to grant Deep Impact Innovations all of the licence rights granted herein; (b) you will not publish fabrications or misrepresentations that could damage Deep Impact Innovations; (c) you will not submit material that isillegal, lewd, defamatory, libellous, intimidating, racially or ethnically offensive, incites criminal conduct, triggers civil liability; (d) you will not post advertisements or solicitations of business; (e) you will not engage in identity theft; (f) you will not send or store material containing malware; (g) you will not disrupt the performance or integrity of the Kyrylity Service or the Deep Impact Innovations servers; or (h) you will not attempt to gain unauthorized access to the Kyrylity Service or the Deep Impact Innovations servers.

 

IV. User Status Submissions of Kyrylity Service users do not represent the views or opinions of Deep Impact Innovations. Deep Impact Innovations does not endorse any User Status Submissions, or any opinions, proposals, or advice expressed therein. Deep Impact Innovations explicitly rejects any and all liability in connection with User Status Submissions. Deep Impact Innovations does not authorize copyright infringement or the infringement of other intellectual property rights via its Kyrylity Service. Deep Impact Innovations will erase all content and User Status Submissions if appropriately notified that such content or User Status Submissions infringe the intellectual property rights of the rightful owner. Intellectual property infringement notifications must becommunicated to Deep Impact Innovations in writing by a person authorized to act on behalf of the rightful owner of the exclusive right that is allegedly infringed. Deep Impact Innovations reserves the right to remove content and User Status Submissions without prior notice. Deep Impact Innovations reserves the right to terminate a user’s access to the Kyrylity Service without prior notice. Deep Impact Innovations reserves the right to terminate the access to the Kyrylity Service of repeat infringers of intellectual property rights. Deep Impact Innovations reserves the right to determine whether content or User Status Submissions are suitable and comply with these Terms of Service following violations other than intellectual property infringement. Deep Impact Innovations will remove User Status Submissions and/or terminate a User’s access for uploading material in violation of these Terms of Service without prior notice and at its sole discretion.

 

V. You acknowledge and agree that when using the Kyrylity Service you will be subjected to User Status Submissions from numerous sources, and that such User Status Submissions are not the responsibility of Deep Impact Innovations. Deep Impact Innovations is not responsible for the validity or legality of such User Status Submissions. You acknowledge and agree that you may be subjected to User Status Submissions that areerroneous, unpleasant, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or recourse you have or may have against Deep Impact Innovations with respect thereto. You further agree to indemnify and hold Deep Impact Innovations, its officers, directors, employees, agents, affiliates, and/or licensors, blameless to the maximum extent permitted by law concerning all matters associated with your use of the Kyrylity Service.

 

VI. Deep Impact Innovations authorizes you to use the Kyrylity Service for personal purposes only. Deep Impact Innovations reserves the right to suspend any feature of the Kyrylity Service without prior notice and at its sole discretion.

 

6. Deep Impact Innovations Warranty Disclaimer

Youacknowledge and agree that your use of the Kyrylity Service shall be at your sole discretion and risk. Deep Impact Innovations, its officers, directors, employees, agents, affiliates, and/or licensors reject to the maximum extent permitted by law all guarantees, express or implied, relating to the Kyrylity Service and your use thereof. Deep Impact Innovations makes no warranties or representations about the validity of the Kyrylity Service’s content. Deep Impact Innovations assumes no liability or responsibility for (a) any inaccuracies or deficiencies of Kyrylity Service content; (b) any personal injury or property damage, of any nature, sustained by you as a consequence of your access to and use of the Kyrylity Service; (c) any unauthorized access to the Deep Impact Innovations servers; (d) any unauthorized access to Kyrylity Service user personally identifiable information and/or financial information stored on Deep Impact Innovations servers; (e) any interruption or cessation of the Kyrylity Service; (f) any viruses or malware propagated by third parties which may temporarily disrupt the integrity of the Kyrylity Service; or (g) any loss or damage, of any nature, sustained by you as a consequence of content made available to you via the Kyrylity Service. Deep Impact Innovations warrant, recommend, or assume responsibility for any product or service offered by a third party via the Kyrylity Service. Deep Impact Innovations will never be party to or in any way responsible for any transaction through any medium between you and third party providers of products and services.

 

7. Deep Impact Innovations Limitation of Liability

Under no circumstances shall Deep Impact Innovations, its officers, directors, employees, agents, or affiliates, be liable to you for any direct, indirect, special, punitive, or consequential damages of any nature whatsoever, whether based on warrant, contract, tort, or any other legal theory, resulting from (a) any inaccuracies or deficiencies of Kyrylity Service content; (b) any personal injury or property damage, of any nature, sustained by you as a consequence of your access to and use of the Kyrylity Service; (c) any unauthorized access to the Deep Impact Innovations servers; (d) any unauthorized access to Kyrylity Service user personally identifiable information and/or financial information stored on Deep Impact Innovations servers; (e) any interruption or cessation of the Kyrylity Service; (f) any viruses or malware propagated by third parties which may temporarily disrupt the integrity of the Kyrylity Service; g) any loss or damage, of any nature, sustained by you as a consequence of content made available to you via the Kyrylity Service; and/or (h) the disclosure of information pursuant to these Terms of Service or Privacy Policy. The aforementioned Limitation of Liability shall apply to the maximum extent permitted by law in the relevant jurisdiction.

You expressly acknowledge and agree that Deep Impact Innovations shall in no way be held liable for any User Status Submissions or the harmful or illegal conduct of any third party. You acknowledge and agree that the risk of harm or damage from the conduct of any third party rests entirely with you.

The Kyrylity Service is controlled and offered by Deep Impact Innovations from its offices in England. Deep Impact Innovations makes no warranties or representations that the Kyrylity Service is appropriate or accessible for use in other jurisdictions. Individuals accessing or using the Kyrylity Service from other jurisdictions do so at their own discretion and risk and must comply with local laws and regulations.

 

8. Indemnifying Deep Impact Innovations

You agree toprotect, indemnify and hold blameless Deep Impact Innovations, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including attorney fees) arising from: (a) your access to and use of the Kyrylity Service; (b) your breach of any term of these Terms of Service; (c) your breach of any third party intellectual property right or privacy right; or (d) damage caused by your User Status Submissions to a third party. Your foregoing indemnification commitment will survive these Terms of Service and your use of the Kyrylity Service.

 

9. Your Ability to Accept Terms of Service

You hereby confirm that you are at least 16 years of age, and are fully able and competent to contractually enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. If you are under 16 years of age, you are not authorized to use the Kyrylity Service. You represent and warrant that you are not located in a country that is subject to international sanctions, a U.K. Government embargo, or a U.S. Government embargo. You further represent and warrant that you have not be included on any international prohibited or restricted parties watch list, a U.K. Government prohibited or restricted parties watch list, or a U.S. Government prohibited or restricted parties watch list.

 

10. Assignment

These Terms of Service, and any rights and licences granted hereunder, may not be transferred or assigned by you, but may be assigned by Deep Impact Innovations without restriction.

 

11. General

You acknowledge and agree that: (a) the Kyrylity Service shall be deemed solely based in England; (b) the Kyrylity Service shall be deemed a passive service that does not give rise to personal jurisdiction over Deep Impact Innovations, either specific or general; and (c) that you agree to the jurisdiction of English courts in the event of any legal dispute. These Terms of Service shall be governed by English Law. Any claim or dispute between you and Deep Impact Innovations that arises in whole or in part from the Kyrylity Service shall be decided exclusively by a court of competent jurisdiction located in England. These Terms of Service, together with the Deep Impact Innovations Privacy Policy and any other legal notices published by Deep Impact Innovations, shall constitute the entire agreement between you and Deep Impact Innovations concerning the Kyrylity Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term. The failure by Deep Impact Innovations to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. Deep Impact Innovations reserves the right to amend or modify these Terms of Service at any time, and it is your responsibility to review these Terms of Service for any changes. If you do not agree to the revised Terms of Service, your only recourse is to discontinue the use of the Kyrylity Service. Your continued use of the Kyrylity Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms.

You and Deep Impact Innovations hereby agree that any course of action arising out of or related to the Kyrylity Service must commence within 3 (three) months of the occurrence of the cause of action. Failure to instigate a course of action within the agreed timeframe renders the cause of action permanently barred.

Privacy Policy

The Deep Impact Innovations Privacy Policy is an integral part of the Deep Impact Innovations Terms of Service. Your access to and use of the Kyrylity software, the mobile smart device application Kyrylity Contacts, www.kyrylity.com (the “Kyrylity Website”)(collectively, including all content delivered by Deep Impact Innovations through Kyrylity Contacts and the Kyrylity Website, the “Kyrylity Service”) remains subject to the terms of this Privacy Policy and the Deep Impact Innovations Terms of Service.

This Privacy Policy is designed to help you make an informed assessment about whether to use or continue using the Kyrylity Service. If you do not agree with any part of the Deep Impact Innovations Privacy Policy, you are not authorized to use the Kyrylity Service.

Under this Privacy Policy, any User Status Submissions or any other content posted via the Kyrylity Service at the instigation or discretion of users will be deemed published content and not considered personally identifiable information.

 

The Scope of the Deep Impact Innovations Privacy Policy

This Privacy Policy covers the treatment of user information, including personally identifiable information, obtained by Deep Impact Innovations from user access to and use of the Kyrylity Service.

This Privacy Policy does not apply to the practices of third party companies that Deep Impact Innovations does not own or control, or to third party individuals whom Deep Impact Innovations does not employ or manage. Further, this Privacy Policy does not apply to third parties to which Deep Impact Innovations may disclose user information in accordance with this Privacy Policy.

 

Information Collected by Deep Impact Innovations

Deep Impact Innovations may acquire the following sorts of information from or concerning you or your mobile smart device, which may be used to identify you (“Personally Identifying Information”):

(I)                 Information Provided by the Kyrylity Service user: You provide Personally Identifiable Information, including without limitation your mobile phone number, Business Profile Personally Identifiable Information, Social Profile Personally Identifiable Information, Business Profile photos, Social Profile photos, messaging status information, mobile smart device information, user registration information. The Kyrylity Service will access the address book or contact list on your mobile smart device to locate the mobile phone numbers of Kyrylity Service users as well as non-users you may invite at your discretion.

(II)               Kyrylity Website and Cookie Information: Deep Impact Innovations servers will send your computer cookies that uniquely identify your web browser when you visit the Kyrylity Website. The Kyrylity Website may not perform correctly if you set your web browser to refuse cookies. Deep Impact Innovations uses both session cookies and persistent cookies. Persistent cookies must be specifically deleted by you while session cookies disappear after you close your browser.

(III)             Kyrylity Website and Server Log Information: Deep Impact Innovations servers automatically log information that your web browser sends whenever you visit the Kyrylity Website. Server log information typically includes your web request, the date and time of your request, pages viewed and the order of those pages, the amount of time spent on particular pages, number of clicks, your Internet Protocol address, your browser type, your browser language, cookies that may uniquely identify your browser, platform type, URLs, landing pages, your mobile phone number, et al. When you use the Kyrylity Service, Deep Impact Innovations servers log general information that that mobile smart device application KyrylityContacts sends whenever messages are sent or received, User Status Submissions are updated or requested, including time and date stamps and mobile phone numbers.

(IV)             The contents of messages delivered via the Kyrylity Service are held and archived on Deep Impact Innovations servers. The Kyrylity Service uses the data service of a user’s mobile smart device (mobile phone network or WiFi) to send messages via Deep Impact Innovations servers to his/her intended recipients. If an intended recipient is online the message will be delivered. If an intended recipient is offline, the undelivered message is held on Deep Impact Innovations servers until it can be delivered. Deep Impact Innovations retains date and time stamp information associated with successfully delivered messages and the mobile phone numbers involved in the messages, as well as any other information which Deep Impact Innovations is legally compelled to collect.

 

Information Not Collected by Deep Impact Innovations

Deep Impact Innovations does not collect email addresses or contact information other than mobile phone numbers from its users’ mobile smart device address books or contact lists. The mobile smart device application Kyrylity Contacts will automatically allocate the same names the Kyrylity Contacts user has assigned mobile phone numbers in his/her mobile address book or contact list to those mobile phone numbers in his/her Kyrylity Contacts primary Business and Social contact lists. This occurs on the mobile smart device itself and not on Deep Impact Innovations servers. Deep Impact Innovations does, however, acquire and store Personally Identifiable Information attributable to the primary and secondary contacts of Kyrylity Service users, including Business Profile Personally Identifiable Information and Social Profile Personally Identifiable Information. Deep Impact Innovations servers will allocate the names Kyrylity Contacts users have assigned to their Business and Social Profiles when displaying the corresponding mobile phone numbers in Kyrylity Contacts secondary contact lists. Deep Impact Innovations does not collect location data, but users may share their location with other users via the Kyrylity Service.

 

How Deep Impact Innovations Uses Information

The Personally Identifiable Information you submit through the Kyrylity Service is used to provide you with the full features and functionality of Kyrylity Service. Your mobile phone number is critical to your use of the Kyrylity Service and will be retained on Deep Impact Innovations servers. Any Personally Identifiable Information, User Status Submissions or any other content that you choose to disclose via the Kyrylity Service will become publicly available information and may be collected and used by other users of the Kyrylity Service (unless such user is blocked by you). Deep Impact Innovations will not use your mobile phone number or other Personally Identifiable Information for commercial or marketing purposes without your consent except as part of a feature development program which you will be able to opt-in or opt-out. Deep Impact Innovations may, however, use your mobile phone number (or email address if provided) without further consent for non-marketing or administrative purposes (including notifying you of Kyrylity Service changes). Deep Impact Innovations may use both your Personally Identifiable Information and non-personally identifiable information (including anonymous user usage data, cookies, IP addresses, browser type, et al) to improve the substance and design of the Kyrylity Service and to create new features, promotions, functionality, and services by storing, monitoring, tracking, and analyzing user preferences and trends. Deep Impact Innovations may use cookies and log file information to: (a) record user input preferences to personalize the Kyrylity Service experience; (b) provide customized content and information; (c) monitor, track, and analyze individual and aggregate metrics; and (d) track user submissions, views et al.

 

Disclosure of Information

Your User Status Submissions are only disclosed in a manner that is consistent with the raison d’être of the Kyrylity Service. If another user has your mobile phone number stored in their mobile smart device address book or contact list, he/she will be able see your User Status Information unless you have chosen to block such user. However, you will only be able to see another user’s Kyrylity Contacts secondary contact lists if both of you store the mobile phone number of the other in your respective mobile smart device address books or contact lists. “Online” and “Last Seen” information is available and displayed to users who have your mobile phone number in their mobile smart device address book or contact list (and who you have not blocked). “Last Seen” reflects roughly the last time the Kyrylity mobile smart device application was used or brought to the foreground on your mobile phone.

Deep Impact Innovations does not and will not sell or share your Personally Identifiable Information (such as mobile phone number) with other third party companies for their commercial or marketing use without your consent or except as part of a feature development program which you will be able to opt-in or opt-out. We may share your Personally Identifiable Information with third party service providers to the extent that it is reasonably necessary to operate, improve or maintain the Kyrylity Service. We may share non-personally identifiable information (including anonymous user usage data, cookies, IP addresses, URLs, platform types, browser type, et al) with chosen third parties looking to analyze the usage patterns for certain content, services, advertisements, promotions, and/or functionality on the Kyrylity Website. Deep Impact Innovations may collect and disclose Personally Identifiable Information and/or non-personally identifiable information if required to do so by law, international law or respond to a court order, subpoena, or search warrant or equivalent. Deep Impact Innovations also reserves the right to collect and disclose Personally Identifiable Information and/or non-personally identifiable information that it believes, in good faith, is appropriate or necessary to enforce the Deep Impact Innovations Terms of Service, take precautions against liability, to investigate and defend itself against any third party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Kyrylity Service or Deep Impact Innovations servers, and to protect the rights, property, or safety of Deep Impact Innovations and Kyrylity Service users.

 

Your Available Options

You may decide not to submit Personally Identifiable Information via the Kyrylity Service. It is your right to refuse to submit Personally Identifiable Information, however, you may be denied access to certain valuable Kyrylity Service features. If you do not agree with our Privacy Policy or Terms of Service, you must delete your account, uninstall the Kyrylity Contacts mobile smart device application and discontinue use of the Kyrylity Service. You are not authorized to use the Kyrylity Service if you do not agree with our Privacy Policy or Terms of Service. However, your continued usage of the Kyrylity Service will confirm your agreement to and acceptance of our Privacy Policy and Terms of Service. To safeguard your privacy and security, Deep Impact Innovations takes reasonable steps to verify your identity before registering your mobile phone number and granting you access to the Kyrylity Service. Deep Impact Innovations Commitment to Data Security

Deep Impact Innovations does not recommend the use of unsecured data services (unsecured mobile phone network or WiFi) to transmit messages via the Kyrylity Service. Upon receipt of your information, Deep Impact Innovations makes the necessary commercially viable efforts to maintain the security of its servers and the Kyrylity Service. Deep Impact Innovations cannot, however, warrant that your information will not be accessed, disclosed, modified, or destroyed by a breach of its physical, operational, and/or technical protective measures. If a security systems breach does occur, Deep Impact Innovations may notify you electronically so that you can take appropriate protective steps or post a notice via the Kyrylity Service.

 

Deep Impact Innovations Commitment to the Privacy of Children

Persons under 16 years of age are not authorized to use the Kyrylity Service at any time or in any manner. Deep Impact Innovations does not knowingly collect or maintain Personally Identifiable Information or non-personally identifiable information on the Kyrylity Service from persons under 16 years of age. No part of the Kyrylity Service is intended for or directed at persons under 16 years of age. Deep Impact Innovations will remove the Personally Identifiable Information and deactivate the account of persons under 16 years of age.

 

Deep Impact Innovations Notice to International Users

The Kyrylity Service is hosted in England and is intended for and directed at users in the United Kingdom.
